1. Acceptance of terms
By accessing or using Wavio, you agree to be bound by these Terms of Service and our Privacy Policy. If you disagree with any part, you may not use our services.
2. Description of service
Wavio provides a WhatsApp API platform that enables you to connect WhatsApp numbers, send and receive messages, manage broadcast campaigns, and integrate with third-party services via webhooks and custom APIs. The service is provided "as is" for lawful business use only.
3. Acceptable use
You agree not to use Wavio to:
- Send unsolicited messages (spam) to users who have not opted in
- Violate WhatsApp's Terms of Service or Business Policy
- Distribute illegal, harmful, defamatory, or fraudulent content
- Conduct phishing attacks or impersonate other entities
- Circumvent rate limits, quotas, or access controls
- Resell or sublicense access to the service without written permission
Violation of these terms may result in immediate account suspension without refund.
4. Account responsibility
You are responsible for maintaining the confidentiality of your credentials and API keys. You are liable for all activity under your account. Notify us immediately at security@wavio.com if you suspect unauthorised access.
5. Subscriptions and billing
Subscriptions are billed in advance for the selected period (monthly, 6-month, or yearly). All prices are in USD. Subscriptions auto-renew unless cancelled before the renewal date. We do not offer refunds for partial periods, except where required by applicable law.
6. Service availability
We target 99.5% monthly uptime. Scheduled maintenance is communicated at least 48 hours in advance. We are not liable for downtime caused by WhatsApp infrastructure changes, force majeure, or third-party service failures.
7. WhatsApp compliance
You are solely responsible for ensuring your use of the service complies with WhatsApp's policies. If WhatsApp bans or limits a connected phone number due to your usage, Wavio bears no responsibility and no refund will be issued.
8. Intellectual property
Wavio and all associated marks, logos, and software are the property of Wavio. You retain ownership of your data and content. By using the service, you grant us a limited licence to process your data solely to deliver the service.
9. Limitation of liability
To the maximum extent permitted by law, Wavio's total liability for any claim arising from these terms or use of the service is limited to the amount you paid in the 3 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
10. Termination
Either party may terminate these terms at any time. You may close your account from the dashboard. We may suspend or terminate accounts that violate these terms. Upon termination, your data will be deleted within 30 days.
11. Governing law
These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in India.
